Terms
and Conditions
All bookings and
enquiries made to A Jay's Disco will be subject to these terms and
conditions. Herein, ‘The Company’ will mean A Jay's Disco and
‘The Customer’ will be the person, persons or company who has
booked and/or will be paying for the services of the company.
Bookings
Contracts must be signed
and a deposit paid to secure your booking. Until signed
contracts and deposit are received by us, your booking will be
classed as provisional and will be held for 14 days from date of
contact. Deposits and contracts not received within this
time will render the booking cancelled and the company reserves
the right to accept another booking for this date.
Payment
All deposits
are non-returnable. The balance of the payment should be made by
cash at the start of the function, or by cheque/postal order no
later than fourteen working days prior to the function. In
the event that you cancel the disco less than seven days before
the date of the function, you will still be liable to pay in full
the agreed fee. Cheques are acceptable and should be made payable
to "A Savory". Referred cheques or cheques completed
incorrectly will be subject to a thirty pounds (£30.00)
administration fee. The agreed fee stated on the Confirmation of
Booking form only covers for services during the stated start and
finish times and the setting up of and dismantling of the
equipment. If any extra service is required it is chargeable at
Twenty Five pounds (£25.00) per half hour with a minimum of half
hour charged and payable in half hour increments. For example if
you require and extra one and a quarter hours you would pay for
one and a half hours. Extra service is also subject to
availability and should be discussed with the performing DJ at the
time, and paid to the DJ at that time. All other methods of
payment will be by mutual agreement. Work completed without
payment received beforehand or on the night, will be re-invoiced
after 28 days at a 10% increase on the original amount, then
another 10% per 28 days outstanding.
Security
and Safety of Equipment
The security
and safety of the equipment during the start and finish times
stated on the Confirmation of Booking form is the responsibility
of the customer (excluding breakdown and technical failure). The
customer will provide adequate supervision of its guests,
including children, at the venue, and will be liable for any loss
of or damage to the equipment or personnel's belongings, caused by
guests attending the function. Should any damage occur to the
equipment in anyway whatsoever, the customer will be liable to pay
for repair or replacement which ever is applicable. No
replacements to be acquired or repairs undertaken by the customer
without prior approval of the company. It is the sole
responsibility of the customer to ensure the good conduct of their
guests towards the DJ's and their assistants. If at any time
before or during the function our DJ's deem their persons or
property to be under threat, verbally or physically, we reserve
the right to terminate the disco without notice. In the event of
this happening refunds are not applicable.
Loading
and Unloading Difficulties
It is the
responsibility of the customer to advise the company when booking
of any unloading/loading difficulties so that these may be priced
for accordingly. If when the DJ arrives at the venue he or she
discovers unloading/loading difficulties, then he will advise the
customer of additional charges for them. If he or she does not
have the manpower or equipment to cater for the unloading/loading
difficulties then he or she will not be able to unload the
equipment and the customer will still be liable to pay the agreed
fee. Unloading/loading difficulties include :- Stairways upwards
or downwards, long walking distances from the parking area to
stage area, narrow corridors, human obstructions i.e. people
crowding doorways, bars, eating areas etc. The normal duration for
the setting up of the equipment is 90 minutes, unloading/loading
difficulties will add to this time. If the customer has not
informed the company of the difficulties then the company will not
be liable for starting late and will still finish at the time
stated on the Confirmation of Booking. It is the responsibility of
the customer to provide an area suitable to set up the equipment
and provide an adequate power supply within three metres. Should
the DJ deem the area to be unsuitable for any reason whatsoever,
he/she reserves the right not to continue with the performance and
the customer shall still be liable to pay the agreed fee.
Content
The company accepts no responsibility for the content of the
disco. The disco will be conducted by a professional DJ with a
great deal of experience of performing discos. Should the DJ be
unable to play a certain song or songs for whatever reasons, the
company accepts no responsibility whatsoever and will not refund
any monies on this basis. It is reasonable to assume that whilst
our DJ’s have vast CD collections there is no way humanly
possible that they will ever have every single title ever
recorded. Should you require certain titles for special reasons
then you should contact the company in advance with your requests.
However whilst every effort will be made to obtain the titles no
guarantees can be given and the company accepts no responsibility
for being unable to obtain and play them. If you own the songs
yourself, the DJ will be happy to play them for you, however the
company accepts no responsibility for loss or damage to your
titles in any way whatsoever.
Liability
In the unlikely event that
the company is unable to perform the disco at the agreed times and
dates, whilst every effort will be made to ensure an alternative
disco is arranged, the company will not be held liable to pay any
costs for anything whatsoever. In the unlikely event that the
company cannot perform the disco for whatsoever reason the company
will give a full refund. The company will not be responsible for
anything or anyone who is damaged or injured in any way
whatsoever. A Jay's Disco operates a strict no access policy
and so no person whatsoever will be allowed in the performing area
at any time from the time of arrival until we have left the
premises of the function.
Sound
limiting devices
We reserve the right to
refuse to work in venues which have sound limiting devices
installed should it be deemed necessary to do so. If such a device
is fitted a smaller show is usually provided. Many sound limiters
we encounter work by cutting mains power at source - as a result
sudden power loss is very likely to cause serious damage to
computer based sound equipment as well as controlled lighting and
also can cause expensive damage to speakers & amplification
hardware. If damage is caused from such a device to audio or
lighting equipment the venue will be fully liable for the cost of
any repairs.
Delays
If the performance start time is delayed due to the inability of
the DJ to gain access to the performance area, or any other delay
beyond the DJ reasonable control, the company will not be liable
for any refund whatsoever.
Special
effect equipment
We accept no responsibility though either the use or consequences
of using special effect equipment. It is up to the customer to
ensure relevant precautions are taken and the relevant people are
informed prior to the function.
